PRESS RELEASE, 4 May 2022

I. At the hearing on 4 May 2022, the Constitutional Court, in the context of the review of laws prior to promulgation, unanimously dismissed as inadmissible the objection of unconstitutionality of the Law approving Government Ordinance No 9/2021 establishing measures to facilitate the use of financial information and financial analysis for the prevention, detection, investigation or prosecution of certain criminal offences, and of the provisions of Article 2 (b) and (c), Article 3 (1), (2) and (7), Article 4, Article 7, Article 10 (4) and Article 20 of Government Ordinance No 9/2021, objection raised by 32 Deputies of the Alliance for the Unification of Romania, the Social Democratic Party and non-affiliated Deputies (insufficient number for referral to the Constitutional Court).

II. At the same hearing, the Constitutional Court postponed the following cases:

–  for 18 May 2022:

1. the objection of unconstitutionality of Article 2 (27) with reference to the insertion of Article 10 ind. 2 into Government Emergency Ordinance No 111/2011 on electronic communications, Articles 10, 13 and 48 of the Law amending certain legislative acts in the field of electronic communications establishing certain measures to facilitate the development of electronic communications networks, objections raised by 50 Deputies of the Parliamentary Group of the Save Romania Union and, respectively, by the Advocate of the People (joined for the hearing of 6 April 2022);

2. the objection of unconstitutionality of the Law amending and supplementing Article 56 ind. 1 of Government Emergency Ordinance No 57/2007 on the regime of protected natural areas, the conservation of natural habitats and of wild flora and fauna, raised by the Deputies of the Parliamentary Group of the Save Romania Union;

– for 2 June 2022, the objection of unconstitutionality of the Law amending and supplementing Framework Law No 153/2017 on the remuneration of staff paid from public funds, objection raised by the Romanian Government.

The decisions are final and generally binding.
