PRESS RELEASE, 15 February 2022

At the hearing of 15 February 2022, the Constitutional Court, context of the review of laws subsequent to promulgation, unanimously upheld the exception of unconstitutionality and declared unconstitutional, in its entirety, the Government Emergency Ordinance No 192/2020 amending and supplementing Law No 55/2020 on certain measures to prevent and combat the effects of the COVID-19 pandemic and amending Article 7 a) of Law No 81/2018 regulating teleworking activity.

The Court declared unconstitutional in its entirety the Government Emergency Ordinance No 192/2020 as it has been adopted in violation of the constitutional provisions of Article 1 (3) and (5) and of Article 79 (1) concerning the approval of draft legislative acts by the Legislative Council.

The Court states that, by the effect of this decision, only the provisions contained in the Government Emergency Ordinance No 192/2020 are removed from the active substance of the legislation, in accordance with Article 147 (1) and (4) of the Constitution, while the other normative texts of Law No 55/2020 on certain measures to prevent and combat the effects of the COVID-19 pandemic and of Law No 81/2018 on regulating teleworking activities remain in force.
