PRESS RELEASE, 19 October 2021

At the hearing of 19 October 2021, the Constitutional Court, in the context of the review of laws subsequent to the promulgation, unanimously pronounced the following decisions:

  1. Upheld the exception of unconstitutionality and found constitutional the provisions of Article 88 (1) b) of the Criminal Procedure Code insofar as they do not refer to the persons who didn’t exercise their right to make statements as witnesses, pursuant to Article 117 (1) a) and b) of the Criminal Procedure Code.
  2. Upheld the exception of unconstitutionality and found constitutional the phrase “the initial registration for the right to pension” contained in Article 170 (3) of the Law No 263/2010 on the unitary system of public pensions, insofar as from the correction index stipulated by Article 170 of Law No 263/2010 also benefit the beneficiaries of old-aged pensions that have been established after 1 January 2011 and have been converted from partial early retirements which were previously established.
