I. At its hearing of 26 January 2022, the Constitutional Court, in the context of the review of laws prior to promulgation, unanimously decided::
– Upheld the objection of unconstitutionality raised by the Romanian Government and found that the Law amending and supplementing Article 229 of Law No 71/2011 implementing Law No 287/2009 on the Civil Code was unconstitutional;
– Upheld the objection of unconstitutionality raised by the Romanian Government and declared unconstitutional in its entirety the Law supplementing Government Ordinance No 2/2001 on the legal regime for minor offences.
II. At the same hearing, the Constitutional Court, in the context of the review of Parliament’s decisions, dismissed as unfounded, by a majority vote, the referral of the Parliamentary Group of the Save Romania Union in the Senate and declared unconstitutional the Senate Decision No 131/2021 for the dismissal of Senator Anca Dana Dragu from the position of Senate President.
Decisions are final and generally binding.
The arguments retained as grounds for the solutions delivered by the Constitutional Court will be set out in the decisions, which will be published in the Official Gazette of Romania, Part I.
III. The Constitutional Court adjourned adjudication until 9 February 2022 in regard to:
– the objection of unconstitutionality of the Law amending and supplementing Law No 407/2006 on hunting and wild game protection, lodged by parliamentarians of the Save Romania Union,
– the objections of unconstitutionality of the provisions of the Law approving Government Emergency Ordinance No 6/2016 on certain measures for the enforcement of technical surveillance warrants ordered in criminal proceedings, objections raised by the Advocate of the People and, respectively, 51 Deputies belonging to the parliamentary groups of the Alliance for the Unification of Romanians, the Social Democratic Party, the National Liberal Party, as well as independent Deputies and a Deputy of the National Minorities Group
– the objections of unconstitutionality of the Law amending Law No 134/2010 on the Code of Civil Procedure, objections raised by the Government of Romania and, respectively, the President of Romania.
