The Constitutional Court Court was vested, on the basis of the first sentence of Article 146 a) of the Constitution, of Article 11 (1) A.a) and of Article 15 of Law No 47/1992 on the organisation and functioning of the Constitutional Court, with resolving, in the context of the review prior to promulgation, the objection of unconstitutionality of the provisions of the Law on State budget for 2022, objection formulated by 51 deputies belonging to the Parliamentary Group of the Union “Salvati Romania” within the Chamber of Deputies.
On 28 December 2021, the Plenum of the Constitutional Court changed, of its own motion, pursuant to Article 230 of the Civil Procedure Code read in conjunction with Article 14 of Law No 47/1992, the initially set hearing date, from 29 December 2021 to 28 December 2021, when it ruled on the objection of unconstitutionality mentioned above.
Following deliberations, the Constitutional Court, by unanimity:
1. Dismissed, as inadmissible, the objection of unconstitutionality of the provisions of Article 6 (2) of the Law on State budget for 2022.
2. Dismissed, as unfounded, the objection of unconstitutionality and found that the provisions of Article 54 of the Law on State budget for 2022 were constitutional in relation to the criticism of extrinsic unconstitutionality formulated only in so far as their application takes place after a possible amendment or completion of Law No 334/2006 on financing the activity of political parties and electoral campaigns.
3. Dismissed, as unfounded, the objection of unconstitutionality and found that the provisions of Article 56 of the Law on State budget for 2022 were constitutional in relation to the criticisms made.
The decision is final and generally binding and shall be notified to the President of Romania.
