I. On 9 December 2021, the Constitutional Court, in the context of the review of laws prior to the promulgation, by a majority of votes, upheld the objection of unconstitutionality formulated by 47 senators and 109 deputies belonging to the parliamentary groups of the Social Democratic Party and found that Law approving the Government Emergency Ordinance No 89/2021 supplementing Article 46 of Law No 41/1994 on the organisation and functioning of the Romanian Radio Broadcasting Corporation and the Romanian Television Corporation was unconstitutional as a whole.
II. On the same day, the Constitutional Court, in the context of the review of the laws subsequent to the promulgation, by unanimous vote, upheld the exception of unconstitutionality and found that the phrase “precisely and literally” contained in Article 323 (1) of the Civil Procedure Code, as amended by Article I point 35 of Law No 310/2018, was unconstitutional.
